The conductor was imposed with punishment of stoppage of annual increment for a period of 2 years with cumulative effect for misappropriation of Rs.21/-. The respondent trade union has preferred an appeal before the Managing Director of petitioner management and the punishment was modified as stoppage of increment for 1 ½ years with cumulative effect. As against the same, an industrial dispute was raised before the Labour Court by the trade union. The Labour Court has allowed the industrial dispute filed by the trade union on the ground that the management has failed to produce any single document pertaining to the domestic enquiry and no passenger was examined. 2/4 https://www.mhc.tn.gov.in/judis WP(MD)No.15327 of 2022 3.Admittedly the petitioner management has not placed the enquiry report before the Labour Court. Therefore, this court finds no reason to interfere with the award dated 11.02.2020 passed by the Labour Court and therefore, the writ petition is dismissed. No costs.
