By means of this petition, the petitioner has inter alia challenged the order passed by the Revisional Authority by which though the revision of the petitioner has been admitted under Rule 80 of the Uttar Pradesh Minor Minerals (Concession) Rules, 2021 the interim relief application has been rejected. Going through the impugned order, we are of the opinion that the relevant aspects have been not been considered while rejecting the interim relief application and based on the orders impugned in the revision recovery of Rs.2,31,71,775/- is sought to be made from the petitioner and certain Division Bench judgments alleged to be annexed with the revision have not been taken into consideration, which, according to the petitioner's Counsel cover the matter in issue before the Revisional Authority, therefore, looking into the facts and circumstances, the writ petition is disposed of with a direction to the Revisional Authority to dispose of the revision at the earliest say within a period of one month after considering the order dated 20th November, 2024 passed by a Division Bench of this Court, which has not been complied with and till the disposal of the revision, no recovery shall be made from the petitioner in pursuance to the impugned order especially as the revision is a statutory one.
