This application under Section 482 of BNSS, 2023 has been filed by the petitioner, namely, Azgor Ali who is apprehending his arrest in connection with Biswanath Chariali P.S. Case No. 105/2025 under Sections 61(2)/318(4)/316(2)/318(2) of BNS. The gist of accusation in this case is that one Rajdeep Newar had lodged an FIR before the Officer-in-charge of Biswanath Police Station, inter alia, alleging that on 22nd of May, 2025, an information was received by the police of Biswanath Chariali Police Station regarding illegal money transaction network operating in various parts of Assam with its centre of attention in Biswanath. Accordingly, three accused persons named in the FIR were arrested. In the FIR, another accused person, namely, Amar Sarmah, has also been stated as one of the suspect. It is submitted on behalf of the petitioner that pursuant to this Court’s order dated 13.06.2025, the petitioner has appeared before the I/O and his statement has been recorded and therefore, the petitioner’s custodial interrogation is not necessary in this case. On the other hand, the learned Addl. P.P. has submitted that the petitioner, namely, Azgor Ali is one of the main players of an organized gang of online gambling, who used to collect different persons throughout the State having current accounts and used the said current accounts on commission basis for the purpose of illegal gambling transactions. It is also further submitted by the learned Addl. P.P. that merely because the petitioner has appeared before the I/O and got his statement recorded does not imply that his further custodial interrogation is not necessary. On perusal of the materials available on the record and the state wide ramifications involving organized crime, I do not find the present case to be a fit case for grant of pre-arrest bail.
Consequently, the prayer of pre-arrest bail stands rejected and the order of interim pre-arrest bail dated 13.06.2025 stands vacated. The anticipatory bail application stands disposed of. Page No.# 3/3 Send back the case diary. JUDGE Comparing Assistant
