Mr. Lalit Sharma (through V.C.) and Ms. Suraiya Naaz, learned counsel for the applicant. 2. Mr. Deepak Bhardwaj, learned Brief Holder for the State. 3. The present applicant – Jeevan Chandra Pandey, S/o Kaustuba Nand, is praying for regular bail in reference to FIR dated 27.09.2024, bearing FIR No. 0484 of 2024 registered at P.S. – Rudrapur, District – Udham Singh Nagar, which was lodged against two persons namely Vishal Singh and Sweety Singh for the offences punishable under Sections 316 (2), 318 (4), 336 (3), 338, 340 (2), 126(1) of BNS, 2023. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated which is evident from the fact that applicant is not named in FIR. 5. Apart from this, he submits that another co- accused has been enlarged on interim bail by this Court on 04.06.2025. He further argued that another co-accused Khulid Malik @ Khalid has also been granted interim bail by this Court by order dated 03.06.2025. Copy of the order passed by this Court is annexed at page 35 and 38 to the bail application. 6. He further argued that present applicant is only witness of the loan document. He further submits that charge sheet has already been filed and applicant is languishing in jail since 27.10.2025. 7. On the other side, State Counsel has not disputed that two co-accused have already been enlarged on interim bail and present applicant is not named in the FIR and only because he put his signature on the loan document, he is made an accused. 8. After hearing the arguments of learned counsel for the parties and taking into consideration that the charge-sheet has already 2025:UHC:11672 been filed and applicant is languishing in jail since 27.10.2025 and co-accused have already been enlarged on interim bail, this Court is of the view that the applicant deserves for bail. 9. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 10. Let the applicant - Jeevan Chandra Pandey, S/o Kaustuba Nand, be released on bail on his executing a personal bond and furnishing two reliable sureties each of the like amount to the satisfaction of the court concerned.
