This anticipatory bail application under Section 438 and 440 of the Code of Criminal Procedure, 1973, has been preferred by the petitioner apprehending her arrest for offences registered under Sections 341, 323, 376(2)(n), 504 and 506 of the Indian Penal Code, section 6 of the POCSO Act and section 67 of the Information Technology Act, 2000. 3. From the impugned order and material on record, I find that the allegation is that the informant who is aged about 16 years was forcibly taken by the brother-in-law of this petitioner and they spent night at some place. It is alleged that the said offender namely Benedik Soren has taken obscene photograph of the victim girl. The allegation against this petitioner and her sister (that is the wife of Benedik Soren) is that they watched those obscene photographs and thereafter called the victim and slapped her and assaulted. 4. Considering the nature of allegation against this petitioner and the fact that the petitioner is a lady and there is nothing to 2025:JHHC:11672 2 suggest that the petitioner had supported Benedik Soren who is the main accused in commission of the offence, I am inclined to allow this anticipatory bail application to the petitioner. 5. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of her surrender or arrest, she shall be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional District Judge-cum-Spl. Judge, Godda, in connection with Lalmatiya P.S. Case No.47 of 2023, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in her name or in the name of her ancestors in which she is having share and to that effect, she has to file an affidavit before the Trial Court indicating her share in the property.
