Neutral Citation No. - 2025:AHC-LKO:41990 Court No. - 18 Case :- WRIT - A No. - 5834 of 2025 Petitioner :- Khadya And Rasad Pensioners Welfare Association ,Thru. Secy. Ved Prakash Sharma Respondent :- State Of U.P. Thru. Addl. Prin. Secy. Food And Civil Supplies Deptt. Lko. And 2 Others Counsel for Petitioner :- Rajesh Kumar Awasthi Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J. Heard learned counsel for petitioner and learned State Counsel for opposite parties. Petition has been filed on behalf of Khadya and Rashad Pensioners Welfare Association to its Secretary seeking following prayers:-
"(i)) to issue a writ, order or direction in the nature of mandamus commanding/directing the opposite parties to strictly follow the time limit for deciding the claim of medical reimbursement prescribed in Rule-17 of the Uttar Pradesh Government Attendance) Rules, 2011. Servant (Medical (ii) to issue a writ, order or direction in the nature of mandamus commanding/directing the opposite parties to not make any unacceptable objection for grant of medical reimbursement. iii) to issue a writ, order or direction in the nature of mandamus the opposite parties should be directed not to raise unnecessary objections in providing medical reimbursement. (iv) to issue a writ, order or direction in the nature of mandamus the opposite parties should be directed to restrain the head of the office, as well as head of the department from getting any financial or general examination of claim of the medical reimbursement from anyone other than them. (v) to issue a writ, order or direction in the nature of mandamus directing the opposite parties to direct head of the office, head of the department, Chief Medical Officer/Chief Medical Superintendent as well as Treasury Officer to maintain a register containing details of the claim of medical reimbursement received and payments made, which shall be accessible to pensioners on demand." It is evident from a perusal of the aforesaid prayers that except
for prayer No.1, the remaining prayers are completely vague in nature and can not be acceded to. Even otherwise in the considered opinion of this Court, the association as a whole would not have any locus with regard to raising individual disputes of its members pertaining either to rejection of medical reimbursement claim or for its processing within the time limit prescribed.
It would also be self evident that in case any time limit has been prescribed in Rules of 2011 for deciding claims of medical reimbursement, the same shall be adhered to by the opposite parties. In view thereof, this Court does not find this petition to be maintainable at the behest of association. Liberty however is granted to its members to approach this Court individually in case of any grievance with regard to their medical reimbursement claims.
