Applicant being accused has approached this Court through this application under Section 482 Code of Criminal Procedure seeking quashing of the summoning order dated 30.1.2003 passed by Additional Chief Judicial Magistrate-I, Sitapur as well as order dated 6.2.2008 passed by Additional Chief Judicial Magistrate-I, Sitapur, whereby the bailable warrants have been issued against the applicant and the entire proceedings of Case No. 95E/2003, titled State Vs. Britannia Industries Ltd. and another, under Section 7 Prevention of Food Adulteration Act, 1954. Learned counsel for applicant has stated that the proceedings before the trial court have been stayed by the Hon'ble Apex Court, as there was no interim stay order by this Court. On the last date of hearing i.e. on 2.12.2024, time was granted to the learned counsel for applicant in the connected case bearing Application U/S 482 No. 3231 of 2008 to produce the copy of interim stay order passed by the Hon'ble Apex Court. Needful has not been done, and again a request for adjournment has been made, but this Court is not inclined to adjourn the case. Further, learned counsel for applicant has not assisted on the merits of the case, therefore, the application is dismissed for want of prosecution. Order Date :- 6.1.2025 P.S.
