Heard Sri Om Prakash Srivastava, the learned counsel for the applicant as well as Sri Jayant Singh Tomar, the learned A.G.A.-I for the State and Sri Mohammad Kashif, the learned counsel for the complainant. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 0313 of 2024, under Sections 419 420, 467, 468, 471, 323, 504, 506 I.P.C., registered at Police Station Jankipuram, District Lucknow. 3. The aforesaid case has been registered on the basis of F.I.R. lodged on 07.10.2024 against the applicant and another accused person Mukesh Kumar, stating that the complainant fraudulently kept a QR code of his bank account on the petrol pump of the complainant in connivance Mukesh Kumar, who is manager of the petrol pump and he fraudulently got payment of Rs.17,35,000/- transferred to his bank account. 4. In the affidavit filed in support of the bail application, it has been stated that the applicant is a 65 years old person having no criminal history and he has been falsely implicated in the present case . 5. A short counter affidavit has been filed by the learned counsel for the complainant, wherein he has stated that the applicant has refunded the entire amount to the complainant and the parties have entered into a settlement. 6. The State has filed a counter affidavit annexing therewith copies of material collected during investigation and a copy of the compromise. 7. Keeping in view the aforesaid facts and circumstances of the case, I am of the view that the applicant is entitled to be enlarged on bail. 8. Accordingly, this bail application stands allowed.
