The Second Appeal is preferred by the appellant against the Judgment and Decree dated 10.10.2003, passed in A.S.No.62 of 2002, on the file of the learned I Additional District Judge, Machilipatnam, reversing the Decree and
Judgment dated 11.02.2002, passed in O.S.No.761 of 1999 on the file of the learned Principal Junior Civil Judge, Machilipatnam.
2. Sri D.Praveen Kumar, learned counsel representing Sri Sivalenka Ramachandra Prasad, learned counsel for the appellant is present. None appeared for the respondents.
3. Today, when the matter is taken up for hearing, Sri D.Praveen Kumar,
learned counsel representing learned counsel for the appellant submits that the matter has become infructuous as the cause of action does not survive and hence, he requests this Court to close this appeal.
4. Recording the above submission, the Second Appeal is dismissed as infructuous. There shall be no order as to costs.
Interim orders granted earlier, if any, shall stand vacated.
Miscellaneous petitions pending, if any, in this appeal shall stand closed.
