This appeal has been preferred by the State/Appellant under Section 378 of the Code of Criminal Procedure, 1973 questioning the legality and propriety of the Judgment dated 30.10.2017 passed by the Judicial Magistrate First Class, Raigarh, in Criminal Case No. 121/2007, whereby, the Respondent-Asitram Kujur has been acquitted with regard to the offence punishable under Sections 294, 323 and 504 Part-II of IPC. It is alleged by the prosecution that on 11.06.2007 at about 7:00 pm, owing to previous enmity, the complainant/ Ratiyo Bai Kujur, was assaulted by the respondent with the aid of ‘axe’ while using filthy words and threatened her to kill. It, however, appears at the out set from perusal of the record that none of the prosecution witnesses were examined in order to establish the alleged allegations, though sufficient opportunities were given for the said purpose and, in view of such circumstances, the trial court has, therefore, not committed any illegality in acquitting the respondent from the commission of the alleged crime for want of any evidence against him.
3. The appeal being devoid of merit is, accordingly, dismissed.
