(2) Petitioners took a housing loan of rupees ten lakhs from India Shelter Finance Corporation Ltd. Since petitioners defaulted in repayment of loan, therefore the Corporation has invoked the powers available to it under Section 14 of SARFAESI Act. Thus feeling aggrieved, petitioners have approached this Court challenging the order passed by District Magistrate on 21.8.2025. (3) Learned Counsel for the petitioners submits that petitioners are ready and willing to repay the loan, however they need some reasonable time to arrange for the funds for repayment. He submits that petitioners have made a representation to the competent authority in the Corporation on 10.10.2025, Annexure-2 to the writ petition. He confines his prayer and submits that competent authority in the Corporation be directed to take decision on petitioners’ representation. (4) Having regard to readiness shown by petitioners to repay the loan, writ petition is disposed of with a direction to the respondent no. 2 to take decision on petitioners’ representation within four weeks from the date of presentation of certified copy of this order.
