1. Heard.
2. Learned Standing Counsel has written instructions to inform the Court that no proceedings were drawn under Section 24 of U.P. Revenue Code, 2006 read with corresponding Rule 22 of the U.P. Revenue Code Rules, 2016 and nobody has been dispossessed nor the status quo with regard to the land has been changed by the Sub Divisional Magistrate or any other Tehsil authority. The instructions given to the standing counsel also state that a temporary injunction dated 19.03.2025 passed in a civil suit filed by the petitioners is operating which restrains the defendants in the suit from interfering in the possession of the petitioner.
3. As we have not issued any notice to the private opposite parties as yet, we do not quash the order impugned but direct the Sub Divisional Magistrate to do the needful, as, any such proceedings can only be initiated as per law and not otherwise. Let him take a decision in the matter in respect to the impugned order within one week.
4. The impugned order shall have no adverse bearing so far as the rights of the petitioners in the pending suit or otherwise are concerned. The petitioners are at liberty to seek remedy in the pending suit or otherwise. We have not expressed any opinion on the instructions provided by the Sub Divisional Magistrate to the standing counsel and the same shall not be read as a finding of the Court.
5. The writ petition is disposed of. [Manish Kumar, J.] [Rajan Roy, J.] Order Date :- 18.7.2025 Santosh/- Digitally signed by :- SANTOSH KUMAR High Court of Judicature at Allahabad, Lucknow Bench
