Learned counsel for the appellant submits that the present appeal has been filed under Section 449 of the Code of Criminal Procedure, 1973, being aggrieved by the order dated 16.06.2005 passed by the learned Additional Sessions Judge (FTC), Kabirdham, in Special Criminal Case No. 18/2005, whereby the appellant was directed to deposit an amount of Rs. 15,000/-, being the surety amount furnished by him on behalf of an accused in Sessions Trial No. 50/1995 (State vs. Mahendra Pratap & Anr). It is submitted that as the accused failed to appear before the trial Court, on 16.05.2005 the learned trial Court forfeited the bail bond and the surety amount, and proceedings under Section 446 of the CrPC were initiated. Learned counsel further submits that no interim order has been passed by this Court, and that the appellant had initially deposited the said surety amount. However, by flux of time, he is now without instructions from his client. 2. Consequently, this appeal is dismissed as not pressed.
