(2) By means of this writ petition, petitioners have sought the following reliefs: “i. issue a writ, order or direction in the nature of mandamus for directing the respondents to replenish petitioners’ transferrable rights on their land and to make them ‘sirtan’ again, similar to their previous khatauni of category – 4 Non Zamindari Abolition land and to correct their land category from 4B to 4A as it was before; ii. issue a direction with order or direction in the nature of mandamus directing the respondent no. 4 to take a decision on the application submitted by the petitioner on 08/08/2025 expeditiously or within stipulated time.” (3) Learned State Counsel is right in submitting that for declaration of rights over agricultural land, the only remedy available to the petitioner is by way of approaching Assistant Collector, 1st Class, by filing a declaratory suit. (4) Learned Counsel for the petitioner, however, submits that for correction of revenue entries, petitioner has remedy of approaching the competent authority under Section 33/39 of Land Revenue Act. (5) In view of the statement made by 2025:UHC:10488 learned Counsel for the petitioner, writ petition is disposed of with liberty to petitioner to approach competent authority under Section 33/39 of Land Revenue Act.
