Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the 1st and 2nd respondents to consider the proposal of the 3rd respondent through his proceedings in Na.Ka.No.11595/2021/Aa3 dt:27.12.2021 for allotment of alternate house plots for the remainign 632 beneficiaries in the lands in survey no.137/1 in Panangottur Village within a stipulated period as fixed by this Court. For Petitioner : Mr.Krishnasamy Chinnasamy For Respondents : Mr.A.Selvendran Special Government Pleader
ORDER This writ petition has been filed for the issue of a writ of mandamus directing the 1st and 2nd respondents to consider the proposal that has been forwarded by the 3rd respondent through proceedings dated 27.12.2021 and to allot alternate house plots for 632 beneficiaries in Survey No.137/1 in Panagottur Village. 2.Heard Mr.Krishnasamy Chinnasamy, learned counsel for the petitioner and Mr.A.Selvendran, learned Special Government Pleader for respondents. 2 / 6 https://www.mhc.tn.gov.in/judis
3.The main grievance that has been expressed by the petitioner's Sangam is that totally 1042 family were selected for allotment of house sites and out of the same, 410 families were already allotted in Ponmar Village. However, when it came to remaining 632 families, the house sites have not been allotted inspite of the proposal submitted by the 3rd respondent through proceedings dated 27.12.2021. 4.The learned Special Government Pleader on instructions submitted that the subject property in Survey No.137/1 situated at Panagottur Village, has been classified as a 'meikkal arasu poramboke'. In view of the same, the proposal has already been sent to the Commissioner of Land Administration and the Commissioner of Land Registration is taking steps to get the permission before the Hon'ble First Bench in view of the restraint order that has been passed by the Hon'ble First Bench in WP.No.19286 of 2021 through order dated 02.02.2022. 5.In the considered view of this Court, the allotment of house sites for 410 families were made in the land that was classified as Grama Natham at Panagottur Village. However, when it comes to the present allotment, the land has been classified as a 'meikkal' and therefore the authorities will have to necessarily take the permission of this Court since there is a restraint order passed in this regard. In view of the same, there shall be a direction to the 2nd respondent to take necessary steps to move this Court and seek for reclassification. Ultimately, if the permission is 3 / 6 https://www.mhc.tn.gov.in/judis
granted by this Court, reclassification shall be made and the allotment of house sites for the remaining 632 families shall be carried out. 6.This writ petition is disposed of with the above directions. No costs. 10.03.2025 Index : Yes/No NCS : Yes/No KP 4 / 6 https://www.mhc.tn.gov.in/judis
