Heard learned Counsel for the petitioner as well as learned Standing Counsel and Sri Pankaj Gupta, learned Counsel for the respondent no.5. 2. The present petition has been filed with the following prayer: "i. Issue a Writ, order or direction in the nature of 'Mandamus' commanding and directing the respondent authorities to take legal action against the private Respondent No. 6 and remove the illegal encroachment from site of construction of channel (naali) proposed by Gram Panchayat under Gram Panchayat scheme at Serial No. 7 bearing Work ID No. 108681091 at Village Kashmirva Purainiya, Post Bengai, Vikas Khand Rupaideeh, District Gonda and public utility land, in the interest of justice;" 3. The Counsel for the petitioner argues that despite the sanction, the respondent no.6 is creating hindrance. 4. In view thereof, the present petition is disposed off permitting the petitioner to file an appropriate application before the respondent no.2, who shall personally look into the matter and ensure that the sanction constructions take place in accordance with law without any hindrance. 5. The respondent no.2 shall take appropriate action on the application of the petitioner within a period of two months from the date of presentation of the application along with certified copy of this order.
