The present Bail Application under Section 483 of BNSS, 2023 has been filed on behalf of the Applicant, Bablu S/o Rajan R/o Sapera Basti, Mothorowala, P.S. Nehru Colony, Dehradun. 4. The Applicant is currently in judicial custody since in connection with Case Crime No. 252 of 2024, under Sections 20, 8 of Narcotic Drugs and Psychotropic Substances Act, registered at Police Station Rajpur, District Dehradun. Through this application, the Applicant seeks his release on bail. 5. Learned counsel for the Applicant/accused would submit that the Applicant has falsely been implicated in the instant case; the police has not complied with Sections 50 & 60 of NDPS Act; the Applicant has no criminal history and he had no motive to commit the offence. He further submits that the inventory report was not prepared at the spot, therefore, no purpose would be served by keeping the applicant/accused in jail as the trial is likely to take considerable time. 6. Per Contra, learned State counsel has not 2025:UHC:10135 opposed the bail application of the Applicant/accused. 7. In the circumspection of facts as stated above, without expressing any opinion about merits of the case before the Trial Court, this Court is of the view that this is a case fit for bail. 8. The bail application is, accordingly, allowed. 9. Let the Applicant/accused be released on bail on furnishing a personal bond and two reliable sureties, each of the like amount to the satisfaction of the court concerned. 10. Pending applications, if any, stand disposed of accordingly.
