Considering the issue pending before this Court, i.e. an application under Section 24, C.P.C. whereby the proceedings pending before the Court of Principal Judge, Family Court, Gorakhpur, are sought to be transferred to District Bahraich in the Court of competent jurisdiction/Principal Judge, Family Court, Bahraich. A question was put to the learned counsel for the applicant as to how the instant application is maintainable before this Court since the proceedings transfer of which has been sought, are pending in district Gorakhpur, the learned counsel for the applicant, after arguing at some length submitted that he may be permitted to withdraw this application with liberty to approach the appropriate forum/Court.
