The original claimant/ Kishan Govindrao Sirsat died and his heirs are shown in the title clause of application. The cause of action survives against them. They are necessary parties. Respondents didn’t dispute their entitlement. 3. In fact the Respondent No.1/acquiring body should have filed this application for bringing legal heirs on record.
