(2) According to petitioner, despite order passed by the District Magistrate under Section 14 of SARFAESI Act, 2002, local police is not providing necessary help in getting the physical possession of secured asset. By means of this writ petition, petitioner has sought the following relief: “A. Issue a writ, order or direction in the nature of mandamus directing the Respondent Nos. 1 to 3 to assist the petitioner in obtaining the physical possession of the property in question in compliance of the order dated 04.02.2025 passed under Section 14 of the SARFAESI Act, 2022 by the Ld. Respondent no. 1 in Case No. 367 of 2025 for assistance in taking physical possession of the Secured Asset, expeditiously within a period to be determined by this Hon’ble Court in the interest of justice and equity;” (3) Learned State Counsel submits that if petitioner has any grievance, then he should approach the concerned District Magistrate/SSP. (4) Petitioner’s Counsel submits that representation has already been made on 19.9.2025. (5) Writ petition is, accordingly, disposed of with a direction to the concerned authority to take decision on petitioner’s representation, as per law, within four weeks from the date of presentation of certified copy of this order.
