Heard learned counsel for the revisionists, learned counsel for opposite party no.2, learned A.G.A. for the State as well as perused the record. 2. The present revision has been filed by the revisionists for the following main relief:- "WHEREFORE, it is most respectfully prayed that this Hon'ble court may kindly be pleased to quash the order dated 06.02.2023 passed in S.T. No. 1597/2014 by learned Additional Sessions Judge, Court No. 4, Lakhimpur Kheri by which the learned trial court has allowed the application filed under section 319 Cr.P.C. by the respondent no. 2 and summoned the revisionists. The present criminal revision may kindly be allow and the learned trail court may kindly directed to stay summon of the revisionist to face the trial proceeding in the above noted case in the interest of fair justice." 3. After arguing the matter at some length, learned counsel for the revisionists has submitted that liberty may be given to the revisionists to file bail application before the trial court which may be directed to be decided in view of law laid down by the Hon'ble Apex Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation and another, (2022) 10 S.C.R. 351 : (2022) 10 SCC 51 and Musheer Alam vs. State of Uttar Pradesh and Another, 2025 SCC OnLine SC 116. 4. Learned counsel for opposite party no.2 as well as learned A.G.A. has no objection to the prayer made by learned counsel for the revisionists. 5. Keeping in view the aforesaid, the present revision is disposed of with liberty as prayed for and with a direction to the court below that if the Versus Counsel for Revisionist(s) : Abhishek Srivastava, Krishna Mohan Srivastava Counsel for Opposite Party(s) : G.A., Ram Asarey Verma Shubham @ Sugam Kumar And Another .....Revisionist(s) State Of U.P Thru.
