THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.3723 OF 2025 ORDER:
1. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State.
2. The learned counsel for the petitioners submits that the petitioners were arraigned as A.1 to A.3 in C.C. No.299 of 2023 on the file of the Court of the Principal Junior Civil Judge-cum-Judicial Magistrate of First Class, Tanuku, West Godavari District, for the alleged offence under Sections 447, 323, 427, 429, 509 and 506 read with 34 of the Indian Penal Code,
1860.
3. The learned counsel for the petitioner submits that the 2ndrespondent has filed a false complaint, alleging various offences against the petitioner, though there is no truth in the allegations. During the course of the argument, the learned counsel has requested this Court to dispense with the presence of the petitioners in the C.C.
4. Considering the submission of the learned counsel for the petitioner appeared virtually, the 1st petitioner is permitted to represent the other petitioners on filing an application under Rule 37 of the Criminal Rules of Practice before the learned Magistrate. Upon filing such an application, the learned Magistrate shall consider and pass appropriate orders, subject to impose necessary conditions as required for the completion of the trial expeditiously.
5. With these observations the criminal petition is disposed off.
