Order on Board 18/03/2025
1. The review petitioners/respondent Nos.7 to 9 in the writ petition seek review of the order dated 9-1-2025 passed in WPC No.86/2025 on the ground that certain facts & grounds have been suppressed by the writ petitioners during the course of hearing of the said writ petition.

Learned counsel for the review petitioners/respondent Nos.7 to 9 submits that the writ petitioners in WPC No.86/2025 have not disclosed in the writ petition about the pendency of the civil suit
3 as well as the revenue record which is endorsed about the possession of the respondent Nos.7 to 9, hence, the review petitioners would pray for review of the order passed in WPC No.86/2025.
3. I have heard learned counsel for the parties.
4. Considering the entire facts and circumstances of the case, and particulary considering the fact that the civil suit is pending before the concerned competent jurisdictional civil Court, paragraph-7 of the order dated 09/1/2025 passed in WPC No.86/2025 is modified as under:-
“7. It is directed that the Collector, Gariaband shall look into the grievance of the petitioners by providing sufficient opportunity of hearing to the affected parties including the respondents herein and take a decision about the alleged complaint of the petitioners that the respondents have encroached upon the grass land. The Collector shall take a decision within a further period of 30 days from today.”
5. The order dated 09/01/2025 passed by this Court in WPC No.86/2025 is modified accordingly.
6. It is made clear that this Court has not expressed any opinion on the merits of the matter and the review petitioners are at liberty to submit necessary documents before the Collector while hearing the grievance of the parties.

7. Accordingly, the review petition is disposed of.
8. A copy of this order be supplied along with copy of order dated 09/01/2025 passed in WPC No.86/2025 SD/-
