Petitioner has approached this Court of grant of an appropriate writ in the nature of mandamus or direction commanding upon the respondents to consider and grant promotion to the petitioner on the post of Block Panchayati Raj Officer and to pay consequential benefits thereof from the date of respective eligibility and benefits of 2nd M.A.C.P. since December, 2017 and to fix the retiral benefits on the pay scale of higher post within a specified period. 2. In an affidavit dated 05.05.2015, Paragraph No. 7 and 8 following statements have been made :- “7. That it is stated and submitted that meeting of District Establishment Committee held on 15.04.2025. Committee decided to sanction the benefit of MACP to petitioner Anand Deo Yadav, Retd. Panchayat SAchiv from due date 17.12.2017. 8. That it is stated and submitted that as per benefit of 2nd MACP petitioner’s payment fixed and demanded allotment from Panchayati Raj Department, Jharkhand, Ranchi vide letter no. 232 dated17.04.2025. After receipt (2025:JHHC:22150) 2 of allotment payment of MACP will be done to petitioner Anand Deo Yadav.” 3. From the aforesaid submissions made in the counter affidavit, it is clear that the respondents have sanctioned the benefit of MACP to the petitioner and they are waiting for the funds to be released. 4. Considering the aforesaid facts, I direct Principal Secretary, Panchayati Raj Department to release the funds so that the monetary benefits can be extended to the petitioner within a period of eight weeks from the date of the receipt of the copy of this order. 5.
