JUSTICE AHANTHEM BIMOL SINGH 30.04.2025 [1] Heard Ms. G. Pushpa, learned counsel appearing for the petitioner and Mr. Shyam Sharma, learned GA appearing for the respondents. [2] The present writ petition has been filed with a prayer for quashing the impugned suspension order dated 17.03.2015, couple with a prayer for directing the respondents to release the pension and pensionary benefits and also arrear salary of the writ petitioner with effect from the date of his suspension till 28.03.2018, on which date, the petitioner retired from service on attaining the age of superannuation. [3] In the midst of the hearing, Mr. Shyam Sharma, learned GA submitted that the Criminal Cases pending against the petitioner being Cril. (P) Case No. 79 of 2018 (Ref: FIR No. 3 (3) 2015 V.P.S.) U/S: 420/511/120-B IPC in the Court of Chief Judicial Magistrate, KABORA MBAM SAPANA CHANU Digitally signed by KABORAMBAM SAPANA CHANU Date: 2025.04.30 16:13:07 +05'30' Page 2 Imphal West, Manipur, have been disposed of by discharging the petitioner and that the departmental enquiry contemplated against the petitioner in connection with the said Criminal Case has also not been proceeded by the authorities. The learned GA further submitted that after the disposal of the said Criminal Case, the authorities have taken up steps for revoking the impugned suspension order of the petitioner and for payment of his pensionary benefits and arrear of pay due payable to the petitioner. The learned GA further submitted that such proposal of the Government is under active consideration and the present writ petition can be disposed of by issuing a direction to the authorities to expedite the process for payment of the pensionary benefits and arrear pay due payable to the petitioner after revoking the impugned suspension order. [4] In view of the submission advanced by the learned GA and on perusal of the extract of the relevant Government file as well as the order dated 27.01.2025 passed by the Chief Judicial Magistrate, Imphal West, Manipur in Cril. (P) Case No. 79 of 2018, this Court is of the considered view that the interests of justice will be served by issuing the following directions:- (1) The respondents are hereby directed to expedite the process for releasing the arrear pay due payable to the petitioner during the period of his Page 3 suspension and also to release the pensionary benefits due payable to the petitioner after revoking the impugned suspension order dated 17.03.2015 as early as possible. (2) It is made clear that the whole exercise should be completed within a period of 3 months from the date of receipt of a certified copy of this order.
