Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The petitioner was arraigned as Accused in Crime No.144 of 2024 of Vemuru Police Station, Bapatla District, registered for the alleged offences under Sections 192, 196(1), 336(4), 353(2), 79 of the Bharatiya Nyaya Sanhita, 2023 and Section 67 of the Information Technology Act, 2000-2008. 3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the complaint. It is alleged in the complaint that the petitioner posted some abusive content on the social media platform, i.e., Facebook, against political leaders. The learned counsel further submits that the offences alleged against the petitioner are punishable by imprisonment of less than 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Vemuru Police Station, Bapatla District,is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, 3 CRL.P. No.3736 of 2025 insofar as the petitioner is concerned, for the purpose of investigation in connection with Crime No.144 of 2024. 5. Accordingly, the criminal petition is disposed off. 6.
