Ms. Medha Pande, learned counsel holding brief of Mr. Akshay Joshi, learned counsel for the revisionists. 2. Mr. Piyush Garg, learned counsel for the respondent. 3. The instant revision has been preferred under Section 25 of the Provincial Small Causes Courts Act, 1887 against the judgment and order dated 17.09.2025, passed by Judge, Small Causes Court/Addl. District Judge-1st, Kashipur in SCC Suit No. 09 of 2024, titled as “Pradeep Pant vs. Girish Chand & others”. 4. On the previous date, the learned counsel for the revisionist sought time to get the instruction from his client to apprise this Court within how much period he will vacate the property in question. 5. Today, both the revisionists are present in Court, who are the real brothers and undertakes that they will vacate the premises on or before 30.11.2027 without causing any damages to the property in question and will pay now the monthly rent at the rate of Rs. 3,000/- per month from 1st November 2025. 6. Mr. Piyush Garg, learned counsel for the respondent, on instructions, accept the proposal of the revisionist. 7. In such view of the matter and taking into consideration the undertaking as given by both the revisionists two years time is granted to the revisionists to vacate the property in question on or before 30.11.2027 and also directed to pay monthly rent at the rate of Rs. 3,000/- per month from 1st November 2025. 2025:UHC:9992 8. In reference to the aforesaid undertaking, both the revisionists are directed to file the undertaking along with an affidavit before the SCC Court positively within two weeks from today. 9. It is made clear there if there is any breach on the aforesaid condition, the respondent will apprise this Court by moving an application so that the appropriate steps shall be taken against the revisionists. 10.
