Heard learned counsel for the petitioner and learned Standing counsel for the respondents. By this petition, the petitioner has prayed for the following relief:- "(i) Issue a writ, order or direction in the nature of 'Mandamus' commanding the respondent to give the compassionate appointment under the Dying-in-Harness Rules, 1974 to the petitioner on Class IVth employee. (ii) Issue a writ, order or direction in the nature of Mandamus' commanding the respondent to decide the representation dated 28-04-2025, contained as Annexure No. 9 to this writ petition." After arguing for some time, learned counsel for the petitioner submits that the petitioner's grievance would be adequately addressed if the respondent no. 3 is directed to decide his pending representation, contained in Annexure No. 9 to the petition, within a stipulated period. Learned Standing Counsel has no objection to this innocuous prayer. Considering the above, the petitioner is directed to submit a fresh representation before respondent no. 3 within two weeks from today and in case, such a representation is submitted, the same shall be decided by respondent no. 3 within a further period of four weeks by passing a reasoned and speaking order. While passing the order, the necessary inquiry if required under Rule 7 of U.P. Recruitment of Dependants of Government Servant (Dying in Harness) Rules, 1974 shall also be conducted.
