JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 20.06.2025 Heard learned counsel Mr. S Borthakur for the petitioner Ahmed Ali who has filed this application under Section 483 of the B.N.S.S, 2023 with prayer for bail as he is behind bars since 26.04.2025 in connection with Dhupdhara P.S Case No. 21/2025 under Section 87/3(5) of the B.N.S, 2023. Page No.# 2/3 Heard Mr. K Baishya, learned Additional Public Prosecutor, Assam. It is submitted on behalf of the petitioner that the petitioner did not kidnap the victim. Moreover, as the victim has been recovered his custodial detention may not be required. Mr. K Baishya, learned Additional Public Prosecutor, Assam has raised serious objections against the bail petition. I have considered the submissions at the bar with circumspection. The petitioner has been behind bars for 56 days. It appears that further custodial detention may not be required as investigation may have presumably progressed to a certain extent. I have also considered the submission on behalf of the petitioner that the victim girl has already been recovered. It appears that bail may be granted to the petitioner. I have considered the submission that the petitioner is willing to co-operate with the remaining part of the investigation and to abide by any stringent bail conditions if imposed upon him. The petitioner is not a flight-risk as he is a local resident. Considering all aspects, the petitioner is enlarged on bail of Rs 50,000/- with a suitable surety of like amount to the satisfaction of the Ld. Chief Judicial Magistrate, Goalpara under the conditions that the petitioner shall cooperate with the remaining part of the investigation.
