2025:JHHC:18042 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 3545 of 2025 ----- Birendra Lohra, S/o Nandev Lohra, R/o Village Bingda, P.O- Nawagarh, P.S. Latehar, Dist- Latehar .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Ashok Kumar, Advocate For the State : Mr. Naveen Kr. Gaunjhu. P.P …...... 04/ 07.07.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. This is an application filed by the petitioner praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, apprehending his arrest for offences under Sections 395/412 of IPC. 3. It is alleged that the informant was looted by some unknown persons. 4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R., rather his name transpired from the confessional statement of the co- accused to be one of the miscreants. He further submits that petitioner has no criminal antecedent. 5. The learned APP opposes the prayer for anticipatory bail and submits that this case needs to be conducted in presence of the petitioner and he also needs to be put on TIP. 6. Considering the submission of the State and also the fact that during investigation, presence of the petitioner is necessary including the fact that it is necessary to put him on TIP, I find that this is not a fit case for grant of anticipatory bail to the petitioner. 7. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Manika P.S. Case No.01 of 2022, pending in the Court of learned A.C.J.M., Latehar, stands rejected. (ANANDA SEN, J.)
