Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The petitioner was arraigned as A.1 in Crime No.109 of 2024 of Cyber Crime Police Station, NTR Commissionerate, registered for the alleged offences under Sections 66 read with 43 of the Information Technology Act 2000-2008 and Sections 66-C 79, 353(2), 356(2) of the Bharatiya Nyaya Sanhita, 2023. 3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the complaint. It is alleged in the complaintthat the petitioner posted some abusive content on the social media platform, i.e., Facebook, against political leaders. The learned counsel further submits that the offences alleged against the petitioner are punishable by imprisonment of less than 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Cyber Crime Police Station, NTR Commissionerate, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik 3 CRL.P. No.3735 of 2025 Suraksha Sanhita, 2023, insofar as the petitioner is concerned, for the purpose of investigation in connection with Crime No.109 of 2024. 5.
