Prayer in this writ petition is for declaring order, dated 14.11.2025, passed in Crl.MP.No.156 of 2024 on the file of Chief Judicial Magistrate, Nellore, as illegal, arbitrary and violation of Section 14 of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short “SARFAESI Act”).
2. Admittedly, S.A.No.445 of 2022 filed by present petitioner is pending adjudication.
3. During course of hearing, it is agreed between parties that a direction be issued to learned Debts Recovery Tribunal, Visakhapatnam, to finally adjudicate upon the said pending S.A in a time bound manner and till

then, interim order as afforded in this matter vide order, dated 01.12.2025, may enure.
4. It is further submitted that none of the parties shall seek any adjournments as such before the learned D.R.T.
5. Keeping in view of facts and circumstances as above and specifically the consensus arrived at between parties, it is directed that SA.No.445 of 2022 stated to be pending for hearing on 11.05.2026 be finally decided by learned D.R.T on the said date or within a period of three weeks thereafter, in case it is not so possible on 11.05.2026. Interim order granted in this writ petition shall enure till then. It is clarified that interim order shall not be automatically extended thereafter.
6. Writ Petition is accordingly disposed of. No costs. Pending application(s), if any, stand(s) disposed of accordingly.
