Neutral Citation No. - 2025:AHC-LKO:30214-DB Court No. - 2 Case :- WRIT - C No. - 4779 of 2025 Petitioner :- M/S Balaji Construction And Supplier Thru. Proprietor Sri Jang Bahadur Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Gram Vikas Lko. And 2 Others Counsel for Petitioner :- Alok Singh Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. The opposite parties have cancelled the entire tender process, as, out of the three bidders, two were disqualified, leaving only one bidder. This according to the perception of the opposite parties was not in the interest of the State, as, the financial bid would not fetch reasonable price. There is no indefeasible right in a bidder to insist that the tender process should not be cancelled. There is a reason for cancellation in this case which cannot be said to be irrational. The writ petition is accordingly dismissed with liberty to the petitioner to participate in the fresh tender, as and when floated.
