CRM-M-5343-2021 The instant petition had been filed seeking quashing of the complaint dated 17.07.2017 titled as “M/s Biogenetic Health Care versus Kosmed Formulation & Another” bearing COMA 3349 of 2017 alongwith VISHAL SHARMA 2025.09.15 19:08 I attest to the accuracy and integrity of this document IOIN-1-CRM-M-5343-2021 in/and CRM-M-5343-2021 -2- summoning order dated 18.07.2017 passed by the Court of Judicial Magistrate, 1st Class, Patiala. Challenge is also raised to the impugned order dated 27.03.2018 whereby the petitioner had been declared as a proclaimed person in the aforesaid complaint case. 2. Counsel for the respondent-complainant contends that the present petition has been rendered infructuous since the matter had been amicably resolved between the parties before the trial Court and the complaint itself stands withdrawn. 3. There is no representation on behalf of the petitioners and the matters pertains to the year 2021, hence, there is no reason as to why the matter should be deferred any further. Consequently, the main case is pre-pone from 13.10.2025 and the same is taken up on Board today itself. 4. In the fitness of things, Mr. Saurav Rao, Advocate, who is present in Court is appointed as Legal Aid Counsel to assist this Court on behalf of the petitioners. 5. Learned Legal Aid Counsel does not dispute that in the event of withdrawal of the original complaint, no further grievance would survive. 6.
