This application u/s 482 Cr.P.C. has been preferred against order dated 20.05.2022, passed by Principal Judge, Family Court, Firozabad in Case No. 1165 of 2021 (Smt. Khushbu Vs. Vivek Kumar), under Section 125 Cr.P.C., P.S.- Mahila Thana, District- Firozabad, pending in the court of Principal Judge, Family Court, Firozabad. 3. After arguing at some length, learned counsel for the applicant submitted that the prayer as made above is not being pressed and that applicant may be permitted to move an application under Section 126(2) Cr.P.C., along with Application under Section 5 Limitation Act, before the Family Court concerned to recall the ex- parte judgment dated 20.05.2022 and that a direction may be made to the Family Court concerned to decide his application expeditiously in accordance with law. 4. In view of aforesaid, it is directed that in case applicant moves an application under Section 126(2) Cr.P.C., along with Application under Section 5 Limitation Act, before the Family Court concerned within a period of three weeks from today, the same shall be considered and decided expeditiously in accordance with settled law by the court concerned. 5.
