The present Third Bail Application has been moved by the Applicant – Ravi Kumar, aged about 29 years, S/o Shri Braj Nandan Sah, R/o Sanha Naya Tola, Sahebpur Kamal, Baarkhadda, Begusarai. The Applicant is in judicial custody in connection with FIR No. 0588 of 2021, dated 14.11.2021, registered at Police Station Raipur, District Dehradun, for the offences punishable under Section 302 IPC. 2. Heard. 3. Ms. Divya Jain, learned counsel for the Applicant, and Mr. Siddhartha Bisht, learned Brief Holder for the State, have been heard and the record has been perused. 4. This is the Third Bail Application. The earlier two Bail Applications were withdrawn and were not decided on merits. 5. Learned counsel for the Applicant submits that the main ground for seeking bail is the delay in trial. The incident dates back to 13.11.2021 and the FIR was lodged on 14.11.2021. The charge-sheet was filed on 11.02.2022 and charges were framed on 22.12.2022. It is further submitted that the Applicant was earlier released on short-term bail on account of his kidney ailment and he duly complied with all conditions and surrendered on time. 6. Per contra, learned Brief Holder for the State opposes the bail application and submits that, admittedly, there is delay in the trial. 7. Considering the fact that there is a substantial delay in the conclusion of the trial and also keeping in view that one of the primary considerations for grant of bail is the regular appearance of the accused, this Court finds that the Applicant, during the period of his short-term bail, complied with all conditions and surrendered promptly. In such circumstances, this Court is of the view that sufficient grounds exist for grant of bail. 8. Accordingly, the Bail Application is allowed. 9. Let the Applicant be released on bail in the aforesaid case crime number, on his executing a personal bond and furnishing two reliable sureties of the like amount, to the satisfaction of the Court concerned. The Applicant shall strictly comply with the conditions of bail, if any, and shall not misuse the liberty granted to him. 10.
