THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner is praying to enlarge him on bail in Crime No.334/2024 of Rajagopal Nagar Police Station registered for the offence punishable under Sections 4, 25(1B)(b) of the Arms Act, 1959, Sections 109, 118(2), 189(2), 190, 191(2), 351(2) and 352 of the BNS, 2023. 2. Heard both sides and perused the material on record. 3. The F.I.R. is registered against three named accused and others, on a complaint lodged by the victim by name Karthik R. 4. It is alleged that on account of previous enmity, on 20.10.2024 at about 2.15 p.m., accused persons named in the F.I.R. along with six to seven others came armed with talwar and daggers, abused the complainant and his family members - 3 - NC: 2025:KHC:5839 CRL.P No. 643 of 2025 and telling that they will teach a lesson, assaulted the complainant with hands and with an intention to commit murder, petitioner herein wielded a talwar at him aiming at his chest, however, he was rescued by his uncle – Harish. The accused then attacked from behind and stabbed him and caused injuries to the gluteal region. 5. The petitioner is arraigned as accused No.1. It is alleged that the accused have come armed with weapons like talwar and daggers and inflicted injuries to the complainant. It is specifically stated that the petitioner has tried to assault the injured on his chest with a talwar. Even though the wound certificate shows that the injuries are simple in nature, however the description of the injuries are as under: i. Incised wound 8 x 2 cm over right gluteal region. ii. Incised wound 6 x 2 cm over left gluteal region 6. The victim as well as other witnesses have stated that the petitioner herein was armed with a talwar. There is a prima facie case against the petitioner and in the facts and circumstances, the petitioner is not entitled for anticipatory bail. - 4 - NC: 2025:KHC:5839 CRL.P No. 643 of 2025 7. Learned counsel for the petitioner submitted that accused Nos.3 and 4 have been enlarged on regular bail. 8. In the light of the said submission, if any petition is preferred by the petitioner seeking regular bail, the learned Sessions Judge may dispose of the same as expeditiously as possible, in accordance with law.
