1. Present petition has been filed by the petitioner claiming that the seat in question for the election of Gram Pradhan namely seat of Village Chhatauna, Mariyani, Block Rohaniya, District Raebareli, in its rotation ought to have been reserved for scheduled caste, however, despite the representation, no
consideration is being accorded.
2. The learned Standing Counsel states that the reservation is applied only in terms of the formula as prescribed in the Government Order dated 17.03.2021.
3. However, without going into the contention of either of the parties at this stage, as the petitioner had already approached District Magistrate, Raebareli by filing a representation, present petition is disposed off permitting the petitioner to file a fresh representation alongwith a copy of this order before the District Magistrate.
4. The District Magistrate shall thereafter pass a reasoned order explaining as to why the seat cannot be reserved for scheduled caste within a period of six weeks from the date of filing of the representation. While passing the order, the Government Order dated 17.03.2021 shall also be considered.
