The learned Counsel appearing for the third respondent submitted that admittedly a suit is pending between the petitioner and the third respondent. However, Survey No.178/9B was not shown in the suit at all. According to the third respondent, the said land belongs to him. 3. Therefore, the petitioner cannot restrain the third respondent from putting up any construction or enjoying the possession of the said land.
