None appears on behalf of the petitioner to press the petition. 2. An illness slip has been sent by Shri M.A. Khan, learned counsel for the petitioners. However, as the matter is very old, I am no inclined to adjourn the matter. 3. The petition arises out of challenge to an order fixing the rate of rent under Section 29-A(5) of the U.P. Act No.13 of 1972. 4. Considering the fact that the court below has fixed the rent, based upon the circle rate fixed, I do not see any reason to interfere with the said finding of facts. 5. The petition lacks merit and is, accordingly, dismissed. 6. Interim order, if any, stands vacated. 7. This order has been passed in the presence of Shri Rajeiu Kumar Tripathi, learned counsel for the respondent. 8. The amount deposited in terms of the order passed by this Court shall be released to the respondent on his moving an appropriate application.
