ORAL ORDER In this petition, petitioner has sought for the following relief:-
“Wherefore, the petitioner above named most humbly pray that this Hon’ble Court may be pleased to quash the entire proceedings in C.C.No.7578/2023 on the file of 11th Addl. Chief Metropolitan Magistrate, Mayohall at Bengaluru for the offence punishable under Sections 498-A, 323, 504, 506, 34 of IPC and Sections 3 and 4 of D.P. Act, in the interest of justice.”

Learned counsel for the petitioners – accused Nos.1 to 5 and learned counsel for 2nd respondent – complainant have filed a Joint Memo duly signed by the 2nd respondent and learned counsel for petitioners and respondent No.2 and the same is taken on record.

Learned counsel for the petitioners submits that petitioner No.1 is staying abroad and hence, he could not be physically present and he tried to attend video conferencing but due to some issue, he could not appear through video conferencing also. Respondent No.2 and learned counsel for petitioners and respondent No.2 are physically present before the Court and they admit the contents of the Joint Memo which reads as under:-
“JOINT MEMO The petitioners and the 2nd respondent submits as follows:
1. The petitioners and the 2nd respondent submits that, the petitioners have filed the above petition seeking to quash the proceedings in C.C. No. 7578/2023 on the file of 11th Addl. Chief Metropolitan Magistrate, Mayohall at Bangalore for the offence punishable Under Section 498-A, 323, 504, 506, 34 of IPC and Section 3 & 4 of D.P Act.

2. The petitioners and the 2nd respondent submits that, the petitioners being aggrieved by the order of cognizance and issuance of process, the petitioner has preferred the above criminal petition.
3. The petitioners and the 2nd respondent submits that the Petitioner No.1 initiated proceeding in M.C.No.1708/2022 Under Section 13(1) (ia) of the Hindu Marriage Act on the file of 6th Addl. Prl. Family Court Judge at Bangalore, and the parties have entered into a settlement by virtue of the settlement agreement. The 2nd respondent consent to quash the proceedings against the petitioners.
4. The petitioners and the 2nd respondent submits that, the settlement arrived between the petitioners and the 2nd respondent is out of free will, there is no coercion or force, fraud or any undue influence in settling the case.
Wherefore the petitioner and 2nd respondent most humbly pray that this Hon'ble Court may be pleased to permit the to compound the case and quash the proceedings against the petitioner in C.C. No. 7578/2023 on the file of 11th Addl. Chief Metropolitan Magistrate, Mayohall at Bangalore for the offence punishable Under Section 498-A, 323, 504, 506, 34 of IPC and Section 3 & 4 of D.P Act, in the interest of justice.”
4. In view of the aforesaid settlement entered into between the petitioners and 2nd respondent, I pass the following:
ORDER

(i) The petition is disposed of in terms of Joint Memo dated 20.02.2025.
(ii) The proceedings in C.C.No.7578/2023 (arising out of Crime No.153/2022 of 1st respondent – Police) registered for the offences punishable under Sections 498-A, 323, 504, 506, 34 of IPC and Sections 3 and 4 of D.P.Act pending on the file of 11th Addl. Chief Metropolitan Magistrate, Mayohall, Bengaluru, insofar as the petitioners are concerned are hereby quashed.
