GP FOR SOCIAL WELFARE The Court made the following: ORDER Heard Sri Sriman, learned counsel for the petitioner, learned Assistant Government Pleader for Social Welfare for Respondents 1, 3 & 4 and the learned Assistant Government Pleader for Revenue for Respondents 2 & 6. 2. The writ petition is filed impugning the order passed by the 4th respondent-Special Deputy Collector (TW), Polavaram, K.R.Puram in S.R.No.45 of 2023 dated 07.12.2024. 3. Against the order passed by the Special Deputy Collector (TW), Polavaram, K.R.Puram, an appeal would lie to the Deputy Collector to the Project Officer, ITDA, K.R.Puram and Additional Agent to the Government under Rule 3 of the Andhra Pradesh Scheduled Areas Land Transfer Regulation, 1959 (for short “the Rules”). 4. In the writ affidavit, it was pleaded that the petitioner has no alternative remedy, except the filing of the writ petition, although the petitioner has a right of appeal. When this Court pointed out to learned counsel for the petitioner about the right of the petitioner to file an appeal as contemplated under Rule 3 of the Regulation, learned counsel urged the Court to grant liberty to the petitioner to file an appeal before the appellate authority. 5. Given the facts and circumstances, the Writ Petition is disposed of, giving liberty to the petitioner to file an appeal before the appropriate appellate authority. If the petitioner files such an appeal, the appellate authority shall dispose of the same strictly as per the Andhra Pradesh Scheduled Areas Land Transfer Regulation, 1959. No costs.
