THE HONOURABLE SRI JUSTICE CHALLA GUNARANJAN Writ Petition No.8973 of 2025 ORDER: The present writ petition is filed seeking the following relief: “to Issue a writ, order or direction, more particularly, one in the nature of Writ of Mandamus declaring the inaction of the Respondents in considering the petitioner’s representations, dated 10.07.2023 and 20.01.2025, in appointing the petitioner to the post of Record Tracer in XI category or in the alternative in the post of Sramik until a vacancy for the post of Record Tracer becomes available as per the medical examination of C.M.O., APSRTC, Vijayawada, dated 26.07.2022, as illegal, arbitrary, unconstitutional and in violation of Fundamental Rights guaranteed under Article 21 of the Constitution of India and consequentially, direct the Respondents to release pending wages due to the Petitioner and to pass….” 2. Petitioner was working as Driver in APSRTC since 27.08.2000. Medical Board examined the petitioner on 19.01.2020 and found that he is unfit for the post of Driver in A-I category. Later, petitioner filed review before the Chief Medical Officer, who has sent report to the 3rd respondent on 19.01.2021 after conducting second medical examination stating that the petitioner is unfit for the post of Driver in A-I category due to right foot drop, but, however, found to be fit for alternative post of Record Tracer in XI category as per the medical standards of the respondent Corporation. Petitioner has submitted representations, dated 10.07.2023 and 20.01.2025, to the respondents to consider his case to the alternative post of Record Tracer, however, the same have not been considered. Petitioner claims that in terms of 2 CGR, J. W.P.No.8973 of 2025 Section 20(4) of the Rights of Persons with Disabilities Act, 2016, he is entitled to be considered for the aforesaid post. 3. Learned counsel for the petitioner submits that it would suffice to direct the respondents to consider and dispose of petitioner’s representations, dated 10.07.2023 and 20.01.2025. 4. Learned Standing Counsel for the respondent Corporation would submit that the representations of the petitioner will be considered in accordance with law. 5. In view of the aforesaid submissions, without expressing any opinion on merits of the matter, with the consent of both the learned counsel, the writ petition is disposed of directing the respondents 2 and 4 to consider and dispose of petitioner’s representations, dated 10.07.2023 and 20.01.2025 and pass appropriate orders in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
