The instant application has been filed by applicant for quashing the order dated 29.11.2024 passed by Additional District Magistrate (Administration)/Adjudicating Officer Azamgarh in Case No. 1672 of 2024 (State of Uttar Pradesh Vs. Sazid and others), under Section 51 of the Food Safety and Standards Act, 2006, P.S.- Nizamabad, District- Azamgarh. 3. Learned A.G.A. has raised preliminary objection against the impugned order, there is a provision of appeal under Section 70 of Food Safety and Standards Act 2006. The applicant could not make out the case of exceptional nature, which could pursue this Court to entertain this application despite being having statutory remedy of appeal. 4. Learned counsel for the applicant submitted that he wants to withdraw the present application to avail the remedy to file an appeal under Section 70 of Food Safety and Standards Act 2006. 5. In view of above submission, the present application is dismissed as withdrawn with aforesaid liberty.
