The challenge in this petition is made to the order dated 16.09.2025, passed by the court of Special Sessions Judge, Bageshwar, in Misc. Criminal Case No.18 of 2025, Royre Nicole Vs. State of Uttarakhand. Heard learned counsel for the parties and perused the record. The petitioner-Royre Nicole, aged about 60 years, D/o Royre Andre, resident of 65 Rue, D. Annonay 43190 Tence France, at present C/o Harish Singh Mehera, Kalimat Kasar Devi Road, Maat Gram, Post Dinapani, District-Almora, was an accused in Special Sessions Trial No.19 of 2022, State Vs Royre Nicole and Another, in the Court of Special Sessions Judge, Bageshwar (“the Sessions Trial”). The petitioner was acquitted on 30.09.2025 in the Sessions Trial. Thereafter, she moved an application for return of her passport bearing Passport NO.16GF72278, which the police had taken into custody. By the impugned order, the court released the passport subject to the following conditions:- (i) That the petitioner shall execute a personal bond of Rs. 30,000/- with a surety of the same amount. (ii) That the petitioner shall produce an undertaking that till the period for preferring an appeal, she would not leave the country without leave of the Investigating Officer or the court, and as and when the court/the
Investigating Officer would demand the passport, she would produce it. The petitioner is aggrieved by the condition no. (ii) above. Against the judgment and order dated 30.08.2025, passed in the Sessions Trial, the Government Appeal No.89 of 2025, State of Uttarakhand Vs. Royre Nicole and Another, was preferred, which has been dismissed today. The acquittal recorded in favour of the petitioner has already been confirmed. Therefore, there is no impediment on releasing the passport, without any condition, in favour of the petitioner. It is stated that the Passport NO.16GF72278 has already been released to the petitioner. The petitioner need not give any undertaking. She has been acquitted by the trial court and her acquittal has been confirmed by this Court. She is free to go wherever she wants to go.
The impugned order is modified to the extent, as indicated above. The writ petition stands disposed of, accordingly. (Alok Mahra J.) (Ravindra Maithani J.)
