WP(C) No. 3441/2025 p. 1 IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU WP(C) No. 3441/2025 CM No. 7836/2025 Date of pronouncement : 05.12.2025 Uploaded on : 10.12.2025 Nisar Ahmed & Ors. ….Petitioners Through:- Mr. Ch. Nayaz Ahmed, Advocate. V/s UT of J&K & Ors. …..Respondents Through:- Ms. Nazia Fazal, Assisting Counsel vice Mrs. Monika Kohli, Sr. AAG. \ CORAM: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE JUDGMENT (ORAL) 01. All the five petitioners are individual owners of motor vehicles which are being used as public service vehicles pursuant to the route permits. 02. The petitioners come forth with a grievance that in connection with parking of their respective vehicles at the General Bus Stand, Mendhar, they pay regular entry and parking fee to the appointed Contractor, but the respondent Nos. 6 to 12, acting as a law unto themselves, have so monopolized the situation that they subject every Serial No. 139 Supplementary List-I WP(C) No. 3441/2025 p. 2 incoming/outgoing public service vehicles from General Bus Stand, Mendhar to pay Rs. 500/- per trip, and this they do by use of their muscle power. 03. The petitioners’ grievance is that the respondent Nos. 6 to 12 are no one to be a law unto themselves and subject genuine and bona fide owners of public service vehicles in terms of use of bus stand parking to such a fleecing. 04. This Court deems it appropriate to dispose of this writ petition with a direction to the respondent No. 2 – Deputy Commissioner, Poonch to look into the purported grievance of the petitioners and act in case if the petitioners’ grievance is genuine and correct with respect to plying and parking of their respective public service vehicles without suffering any dictation from the respondent Nos. 6 to 12’s end. 05. This writ petition is, thus, disposed of with a direction to the petitioners to provide a certified copy of this order along with a copy of writ petition and the annexures therewith to the Deputy Commissioner, Poonch within a period of ten (10) days from the date of passing of this order, whereupon the Deputy Commissioner, Poonch to consider the matter and pass appropriate directions as may be WP(C) No. 3441/2025 p. 3 warranted in the facts and circumstances of the case, to be looked into by him by passing an order to the requisite effect by hearing the petitioners as well. 06. Petitioners, if still left aggrieved, may approach this Court again by medium of a writ petition. 07. Disposed of along with connected application.
