None appears for respondents 2 to 10. 3.By means of order dated 26.4.2023 (supra), learned Magistrate has rejected the complaint under section 203 CrPC. The order is extracted below : "ददिननाሪक: 26.04.2023 पतनवलली पपेश हहयली। पररिवनदिली कपे दवदनन अधधिवकन कक तलबली कको ससुनन व पतनवलली कन सम्यक पररिशलीलन दकयन। पररिवनदिली दनरिन दवपकलीगण दवजय कसु मनरि इत्यनददि कसु ल नन व्यककत्यक) कपे अदतररिक पनाሪच अजनत व्यदकयोሱ कको उक पररिवनदि परि दवचनरिणनरर तलब दकयपे जननपे कक यनचनन कक गयली हहै। करनको कपे समररन मक शपरपत ्ቚस्तसुत दकयन गयन हहै। पतनवलली कपे अवलकोकन सपे दवददित हकोतन हहै दक पररिवनदिली कपे ्ቚनररननपत अाሪतगरत धिनरिन 156 (3) दिाሪ० ्ቚ०साሪ० कको न्यनयनलय कपे आदिपेश ददिननाሪक 25.08.2021 दनरिन पररिवनदि कपे रूप मक दिजर दकयन गयन रन , धजस परि पररिवनदिली दनरिन अपनपे करनको कको सनदबत करिनपे हपेतसु धिनरिन 200 दिाሪ० ्ቚ० साሪ० कपे अाሪतगरत स्वयाሪ कको तरन धिनरिन 202 दि०्ቚ०साሪ० कपे अाሪतगरत सनकली शलीमतली सरिकोजनली दिपेवली कको पली० डब्ललू० -1 कपे रूप मक तरन ्ቚमकोदि कसु मनरि कको पली०डब्ललू० -2 कपे रूप मक परिलीदकत करिनयन गयन हहै। दिनरिनन ससुनवनई ्ቚनररननपत धिनरिन 156 (3) दिाሪ० ्ቚ० साሪ० दवपकली साሪख्यन-07 ्ቚनाሪशलू कक ओरि सपे एक ्ቚरम सलूचनन ररिपकोरर न्यनयनलय कपे समक ्ቚस्तसुत कक गयली , धजसकपे अवलकोकन सपे दवददित हकोतन हहै दक पकको कपे मध्य वहैवनदहक दववनदि हहै, धजसमपे पररिवनदिली माሪगतरिनम भली बतनरि सससुरि पककनरि हहै। पररिवनदिली दनरिन पररिवनदिपत मपे ददिसम्बरि 2020 मपे रिनदत 11-00 बजपे नन जनत तरन पनाሪच अजनत लकोगको कपे सनर घसुरि मक घसुसकरि लनठली डण्डपे एवाሪ धिनरिदिनरि हधरयनरि सपे मनरिपलीर करिनपे कन करन दकयन गयन हहै , दकन्तसु ककोई दचदकत्सलीय परिलीकण ररिपकोरर दिनधखिल नहली कक गयली हहै। ऐसन ्ቚतलीत हकोतन हहै दक मनत अपनपे दवरू्ቍ दिजर दिहपेज ्ቚदतषपेधि अधधिदनयम एवाሪ अन्य धिनरिनओ मपे दिजर दकयपे गयपे मसुकदिमपे मक दिबनव बनननपे कपे धलयपे यह पररिवनदि साሪकस्रत दकयन गयन हहै। पतनवलली परि उपलब्धि सनቌኚय सपे घरनन स्वनभनदवक ्ቚतलीत नहीሻ हकोतली हहै। अततः पतनवलली परि उपलब्धि सम्पलूणर सनቌኚय कपे दववपेचन कपे आधिनरि परि उक मनमलपे मक दवपकलीगण कको तलब दकयपे जननपे कन ककोई आधिनरि नहीሻ हहै औरि पररिवनदि धिनरिन 203 दि०्ቚ०स० कपे अन्तगरत खिनररिज दकयपे जननपे यकोग्य हहै। आदिपेश ्ቚस्तसुत पररिवनदि धिनरिन 203 दि०्ቚ०स० कपे अन्तगरत खिनररिज दकयन जनतन हहै।" 4.A perusal of the order, extracted above, shows that there is a matrimonial dispute between the parties, particularly between respondent No.5 Sangita and Manish who is son of the petitioner. It further appears that while filing complaint, the petitioner has suppressed the fact that a first information report was lodged by respondent side against his son and himself. The learned Chief Judicial Magistrate while passing the order impugned found that there is an ongoing matrimonial dispute between the parties, in which the petitioner who is father-in-law is also an accused. Although, there is allegation that nine known and five unknown accused persons have assaulted the complainant by breaking into his house with lathi danda and sharp edged weapons, however, there is no medical report filed by the petitioner. Considering all these aspects, the impugned order has been passed. 5.I find no illegality in the impugned order. The petition is dismissed.
