This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner/A3, seeking regular bail, in Crime No.130 of 2023 of Narsipatnam Town Police Station, Anakapalli District. 2. A case has been registered against the petitioner/A3 herein and others for the offences punishable under Sections

8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. The brief facts of the case are that on 26.04.2023, on receipt of the credible information, the SI of Police, Narsipatnam Town Police Station along with staff and mediators apprehended A1 to A3, who were found in possessions of 24.00 kgs of ganja. After conducting panchanama and after seizing the contraband, the SI of Police arrested A1 to A3, who were remanded to judicial custody. During the course of investigation, the arrested accused confessed before the police stating that they used to purchase the contraband from A4 and further, A1 to A3 supplying the said contraband to A5. 4. Heard. Perused the record. 5. Learned counsel for the petitioner submits that this Court granted bail to A1 as per the Orders in Crl.P.No.5258 of 2023 dated 01.08.2023. The case of the present petitioner/A3 also stands on the same footing to that of A1. The learned Assistant Public Prosecutor did not dispute the same. 6. This Court has perused the orders passed by the Court in Crl.P.No.5258 of 2023 dated 01.08.2023 and finds that the facts

pertaining to the petitioner/A3, are similar to that of A1, who was granted bail. Hence, this Court is inclined to grant bail to the petitioner/A3, on the same terms and conditions. (i) The petitioner/A3 shall be released on executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned Additional Judicial First Class Magistrate, Narsipatnam.
(ii) After release, the petitioner shall appear before the Station House Officer concerned, twice in a week i.e., on every Monday and Thursday between 10.00 a.m. and 1.00 p.m., until further orders. (iii) Further, the petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses. 7. Accordingly, the Criminal Petition is allowed. _____________________ T.
