.2025 Heard Mr. R. Baruah, learned counsel for the petitioner. Also heard Ms. J. Gogoi, learned Standing Counsel, ASTC. This writ petition is directed against the claim of the writ petitioner not being entertained for release of Rs. 36,29,065/- by the respondents authorities for the work executed. The petitioner was allotted the work by order dated
16.12.2013. The petitioner duly completed his work and thereafter he submitted his bills. The completion certificate was issued on 19.09.2016 and the total amount of bills raised by the petitioner comes to Rs. 36,29,065/-. However, the respondent authority has defaulted for release of the said amount. In spite of repeated request made to the Department and representations filed, the respondents have neglected to pay the amount dues to the petitioner. Ms. J. Gogoi, learned Standing Counsel, ASTC submits that out of the total amount certain amounts have been paid. It is submitted the balance amount of Rs. 5,07,966/- is still outstanding. The learned counsel for the respondent submits that since there is no dispute with regard to the amount but the department is relying under financial crunch and proposals have been placed for releasing of adequate funds and the same is likely to be received within few months. It is therefore, submitted that the writ petition be disposed of directing the respondents to release the balance amount within a period of four months. Page No.# 3/3 The prayer made is not objected to by the learned counsel for the respondents. Accordingly, without expressing anything on merit, the writ petition stands disposed of.
The respondent authorities will release the balance amount to the petitioner within a period of 120 days from the date of receipt of certified copy of this order. Writ petition stands disposed of in terms of the above. JUDGE Comparing Assistant
