Heard learned counsel for the petitioner, Sri M.A. Khan, learned counsel for the respondent no. 11 and perused the record. 2. The present petition has been filed by the petitioner challenging an order whereby the SCC suit was dismissed as well as the revision has also been dismissed. 3. Considering the fact that the U.P. Act No. XIII of 1972 has been repealed, the present petition is disposed of holding that the petitioner would be entitled to file a fresh proceedings under the Tenancy Act of 2021, if so advised. In case, such an application is filed, the same shall be decided within the time as prescribed in the statute. 4. Office is directed to communicate this order to the concerned Court below forthwith.
